These terms and conditions together with the Additional Job Seeker Terms and the Additional Recruiter Terms (the "Terms") are the terms on which this website www.efinancialcareers-gulf.com and any website which may replace such websites (the "Website") is made available to you ("you"/ "your"). By accessing and/or utilising the Website you agree to be bound by these Terms.

  1. RECRUITER TERMS & CONDITIONS OF USE

  2. 1. Terms and conditions of business
    1. 1.1 All business undertaken between your company/ organisation and eFinancialCareers specified on the booking order form is subject to these terms and conditions of business.
    2. 1.2 Any reference to ‘we’ or ‘us’, ‘our’ or website are references to the website www.eFinancialCareers.com and eFinancialCareers Ltd and websites operated by eFinancialCareers Ltd in cooperation with its Network Partners (Website).
  3. 2. Registration
    1. 2.1 The details provided by you on registration must be true, complete and correct. You agree to notify us immediately of any changes which are relevant to your registration by informing us on + 44 (0)20 7309 7777 or email #request.helpdeskEmail#customerservices@efinancialcareers.com
  4. 3. Your information
    1. 3.1 We will respect your information and undertake to comply with all applicable UK data protection legislation currently in force. This Agreement and all information given by you to eFinancialCareers during the course of or in connection with this Agreement relating to the trade secrets, operations, processes, organisation, business, transactions, dealing, affairs, accounts or finances of your company (other than information which is in the public domain other than by breach of this sub-clause) shall be treated at all times by eFinancialCareers or its employees, agents, representatives and sub-contractors as confidential and shall not be used other than for the purpose of fulfilling this Agreement nor disclosed to third parties without your prior written consent.
    2. 3.2 Other than as required by law, we will not disclose your registration details to any third party without your consent.
    3. 3.3 In order to maintain the integrity of eFinancialCareers we reserve the right to forward contact details to any regulatory authorities when requested to do so including the police; we may also forward contact details where a complaint arises concerning your use of eFinancialCareers and where that use is considered to be inconsistent with these terms and conditions.
    4. 3.4 We reserve the right to recategorise the search location of any job advertisement in the database if we, in our sole discretion, consider it not to be located to maximum benefit. We also reserve the right to remove temporarily or permanently any job advertisement which we, in our sole discretion, consider to be of an unsatisfactory standard for whatever reason.
  5. 4. Our obligation to you
    1. 4.1 We will use our reasonable endeavours to maintain eFinancialCareers in a full operating condition and error free. We shall have no liability for any failures in you accessing eFinancialCareers caused by any software utilised by you when inputting any job posting information.
    2. 4.2 If eFinancialCareers is unavailable to you, through operating difficulties on its part, for more than 7 working days then a pro-rata refund of the monthly fee shall be made to you in the next monthly invoice.
    3. 4.3 eFinancialCareers undertakes to make all reasonable efforts to ensure a reasonable standard of integrity and reliability of the service.
  6. 5. Your obligation to us
    1. 5.1 You agree that you will only use eFinancialCareers in a manner that is consistent with these terms and conditions and in such a way as to ensure compliance with all applicable laws and regulations. In particular you will not use eFinancialCareers to transmit or distribute any material which is defamatory, offensive or of any obscene or menacing character, as which may in our judgement cause annoyance or inconvenience or anxiety to any person including without limitation racial, harassing, threatening, vulgar or abusive material, opinions or messages.
    2. 5.2 You agree to use eFinancialCareers in a way that us consistent with these terms and conditions and in such a way as to ensure compliance with all applicable laws and regulations. In particular, you will not use efinancialcareers.com to post, distribute or transmit any material which is defamatory, offensive or obscene, racist, sexist or which may, in our judgement, be likely to cause offence or annoyance.
    3. 5.3 You agree that any and all job advertisements that you post on the website relate to specific and genuine job opportunities that were available at the time of posting.
    4. 5.4 You agree to take full responsibility for the use of eFinancialCareers made by you and accordingly you accept liability under these terms and conditions for third party use of eFinancialCareers which is in breach of these conditions.
    5. 5.5 We reserve the right to suspend the services offered to you by eFinancialCareers if we have reasonable cause to suspect that you are in any breach of any of the terms of these conditions.
  7. 6. Termination
    1. 6.1 On successful registration and acceptance as an eFinancialCareers user, you shall be entitled to use eFinancialCareers subject to these conditions and any specific conditions contained in the order confirmation, which will remain effective until terminated in accordance with the following conditions.
    2. 6.2 Your right to continue to use eFinancialCareers will terminate immediately on written notice if
    3. 6.2.1 you fail to comply with any of these conditions.
    4. 6.2.2 you become insolvent or bankrupt.
    5. 6.3 We may notify you by giving you one month's prior written notice if we choose to cease to provide eFinancialCareers for any reason.
    6. 6.4 Written notices as required by these conditions will be sent by either email or post to the relevant parties address as set out at the head of these conditions or on the registration form, as appropriate.
    7. 6.5 You may terminate the terms of your contract upon 30 days written notice.
    8. 6.6 Termination of agreements of 6 months' duration or more require a minimum of 3 months' written notice
  8. 7. Indemnity
    1. You agree to be fully responsible for (and fully indemnify us against) all claims, liability, damages, losses, costs and expenses, including legal fees, suffered by us and arising out of any breach of the Conditions by you or any other liabilities arising out of your use of the Website, or the use by any other person accessing the Website using your internet account.
  9. 8. Intellectual property and right to use
    1. 8.1 You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the Website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors.
    2. 8.2 You acknowledge and agree that the material and content contained within the Website is made available for your personal non-commercial use only and that you may download such material and content onto only one computer hard drive for such purpose. Any other use of the material and content of the Website is strictly prohibited. You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.
  10. 9. Limitation of liability
    1. 9.1 WHILE WE WILL USE REASONABLE ENDEAVOURS TO VERIFY THE ACCURACY OF ANY INFORMATION PLACED ON THE WEBSITE, WE MAKE NO WARRANTIES, WHETHER EXPRESS OR IMPLIED IN RELATION TO ITS ACCURACY.
    2. 9.2 The Website is provided on an “as is” and “as available” basis without any representation or endorsement and we make no warranties of any kind, whether express or implied, in relation to the Website, including but not limited to, implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from course of dealing or usage or trade.
    3. 9.3 Whilst we endeavour to ensure the quality of the website and the eFinancialCareers Network, we make no warranties as to the truth or accuracy of job advertisements or resumes posted by recruiters or job seekers, the ability of employers to offer job opportunities to job seekers or the availability of job seekers to fill job opportunities.
    4. 9.4 We make no warranty that the Website will meet your requirements or will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the materials. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.
    5. 9.5 Notwithstanding any other provision in the Conditions, nothing herein shall limit your rights as a consumer under English law.
    6. 9.6 You acknowledge that we cannot guarantee and therefore shall not be in any way responsible for the security or privacy of the Website and any information provided to or taken from the Website by you.
    7. 9.7 We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent misrepresentations) or otherwise out of or in connection with these Conditions for:
    8. 9.7.1 any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or
    9. 9.7.2 any loss of goodwill or reputation; or
    10. 9.7.3 any physical, moral or financial harm that you may suffer as a result of dealing with others with whom you come in contact through the website.
    11. 9.7.4 any special or indirect or consequential losses; in any case whether or not such losses were within the contemplation of either of us at the date on which the event giving rise to the loss occurred, suffered or incurred by one of us arising out of or in connection with the provisions of any matter under these Conditions.
    12. 9.8 Nothing in the Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.
  11. 10. Payment terms
    1. 10.1 All invoices are subject to VAT at the prevailing rate and are payable within 30 days of receipt of invoice. Late payments will render null and void our undertaking to provide this posting service.
    2. 10.2 We have the right to charge interest at the rate of 2.5% per month above the base lending rate of the bank on all or part thereof on all accounts remaining unpaid 30 days after the invoice date.
  12. 11. Severance
    1. If any part of the Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from these Conditions and shall not effect the validity and enforceability of any of the remaining provisions of the Conditions. 12. No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.
    2. 13. Survival
      1. Each provision of these Conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.
    3. 14. Entire Agreement
      1. These Conditions (as amended from time to time) contain the entire agreement between you and us relating to the subject matter covered and supersedes any previous agreements, arrangements, undertakings or proposals, written or oral, between you and us in relation to such matters. No oral explanation or oral information given by either of us shall alter the interpretation of these Conditions. You confirm that, in agreeing to accept these Conditions, you have not relied on any representation save insofar as the same has expressly been made a representation in these Conditions and you agree that you shall have no remedy in respect of any misrepresentation which has not become a term of these Conditions save that your agreement contained in this Clause shall not apply in respect of any fraudulent misrepresentation whether or not such has become a term of these Conditions.
    4. 15. Law
      1. The Conditions will be exclusively governed by and construed in accordance with the laws of England and Wales whose Courts will have exclusive jurisdiction in any dispute, save that the firm has the right, at its sole discretion, to commence and pursue proceedings in alternative jurisdictions.
    5. 16. Applicable law and jurisdiction
      1. The law of England and Wales shall govern these conditions and your use of eFinancialCareers and the parties hereby submit the exclusive jurisdiction of the English courts.


    1. JOB SEEKER TERMS & CONDITIONS OF USE

      1. These terms and conditions apply to your use of the eFinancialCareers.com website and websites operated by eFinancialCareers Ltd in cooperation with its Network Partners (Website). By accessing the website, you agree to be bound by these terms and conditions, if you do not agree to be bound by these terms and conditions, you may not use or access the website and we have the right to restrict or prevent your access to the website.       2. The Website is operated by eFinancialCareers Ltd in cooperation with its Network Partners and is hosted by eFinancialCareers Ltd, part of eFinancialNews Ltd. We will provide you with access to the Website in accordance with these Conditions.

Definitions “Conditions” means these terms and conditions: “User(s)” means (a) user(s) of the Website either collectively or individually, as the context requires; “Personal Information” means any personal details provided by you via the Website; “We/us/our” means eFinancialCareers Limited; “Website” means the website located at www.efinancialcareers-gulf.com, Network Partner site URLs or any subsequent URLs which may replace them; “You/your” means you as a user of the Website.

      9. 1.2.1 You agree to provide personal information which is your own and in all respects true and is not, in any respect, misleading, deceptive, inaccurate or likely to mislead or deceive. We reserve the right to remove any information, which we deem to be misleading, deceptive, inaccurate or of an unacceptable standard.
      10. 1.2.2 You agree to make your resume(s) inactive by clicking the appropriate box on the Create/edit resume screen when you are unavailable for employment.
      11. 1.2.3 By submitting content to the Website, including a job advertisement, resume or any other content such as Ask the Expert you permit any user of the Website to view, store and reproduce such content for personal use. By submitting content to the Website, including a job advertisement, resume or any other content, you also grant us and our affiliates the royalty free, perpetual, irrevocable, sublicenseable, non-exclusive, full right to use, reproduce, modify, publish, translate, transmit, communicate, display or create any derivative works from such content. You should note that we reserve the right to make inactive or delete at any time and without prior notice any registration or resume personal information.
    4. 2. Indemnity
      1. You agree to be fully responsible for (and fully indemnify us against) all claims, liability, damages, losses, costs and expenses, including legal fees, suffered by us and arising out of any breach of the Conditions by you or any other liabilities arising out of your use of the Website, or the use by any other person accessing the Website using your internet account.

      7. 3.1.6 Suspend any user account if we get substantiated complaints from our clients that they are receiving indiscriminate applications from such accounts.
      8. 3.2 We will use our reasonable endeavours to maintain the Website. The Website is subject to change from time to time. You will not be eligible for any compensation because you cannot use any part of the Website or because of a failure, suspension or withdrawal of all or part of the Website due to circumstances beyond our control.
